Legal conditions for the use of opt-in

In Profit, we provide support for getting permission from people, but you yourself are responsible for the proper use of this functionality. To use this in accordance with Dutch Legislation, you must comply with a number of conditions.

  • Only send mass e-mails to people who have granted their permission in advance (via opt-in), or to people with an association that justifies sending the message (such as: sending a message to the customer's contact person regarding changes to terms and conditions).
  • Every e-mail sent out in a mass e-mail must contain an option for the recipient to cancel his opt-in. This can be done by including a link to the unsubscribe page in the e-mail.
  • Make certain that another form of proof of permission is received and stored when permission is granted by a method other the opt-in process on the OutSite site. For example, have the person sign a form granting permission to be sent updates by e-mail.

Regulations in Belgium

Stricter regulations apply in Belgium. For instance, the following information must be provided in the confirmation message:

  • Name and address of the company (reference to the product, website or e-mail is not enough)
  • The purpose of recording the data (such as direct marketing).
  • A statement that the person has the right to retrieve/correct the details.
  • Who the recipients/categories of recipients of the data are.

You can add the above items by creating a new message template and including these items in it. Moreover, in Belgium the e-mailing must also:

  • Clearly feature the text reclame ('advertisement') if this is not clearly evident form the message
  • Clearly state who is sending the advertisement This can be done, for example, by adding the text: 'This message was sent by and on behalf of XYZ'.
